Terms and Conditions

These Terms of Service (the “Terms”) govern your access to and use of this website (the “Site”) owned and operated by Forward Wisconsin PAC (“FW PAC”), a 501(c)(3) nonprofit organization.

By accessing or using the Site, you are agreeing to these Terms and entering into a legally binding contract with FW PAC.

If you are unwilling or unable to be bound by the Terms, do not access or use the Site.

FW PAC reserves the right, in its sole discretion, to change, modify, add, or delete portions of these Terms at any time without notice. SITE RESTRICTIONS

The Site and the services offered through the Site are only for personal, non-commercial use. To access or use the Site, you must be 13 years old or older and have the requisite power and authority to enter into these Terms. The owner of the Site is based in the United States. FW PAC provides this Site for use only by persons located in the United States. FW PAC makes no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

OWNERSHIP

As between you and FW PAC, FW PAC owns all right, title, and interest in the Site, including the look and feel of the Site and the content thereon. Your use of the Site does not grant you any ownership interest in the Site or any element thereof.

PROHIBITED CONDUCT

You may not use the Site to take any action that could harm FW PAC or any third party, interfere with the operation of the Site, or use the Site to violate any law. By way of example but not limitation, you may not: (a) act in a manner that negatively affects other users’ ability to engage in real-time exchanges; (b) alter, edit, or delete the materials on the Site, including the deletion of any trademark or copyright notices on the Site; (c) interfere with or disrupt the Site, FW PAC’s servers, or networks (e.g., “flooding” or the sending of mass unsolicited messages) or otherwise harm the Site or other users; (d) intentionally or unintentionally violate any applicable local, state, national, or international law or any regulations having the force of law; (e) impersonate any person or entity or misrepresent your connection to any person or entity; (f) “stalk,” harass, or otherwise advocate the stalking or harassing of another person; (f) collect or store personally identifiable information about other users in connection with the prohibited conduct and activities set forth herein; (h) reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes, any portion of the Site; (i) attempt to override or circumvent any security measures of the Site or FW PAC’s third-party providers or access parts of the Site you are not authorized to visit; (j) engage in any unauthorized screen scraping, database scraping, or spidering, or collection of personally identifiable information, or use any other automated means to collect information from the Site; (k) use any software, tool, or other device (such as browsers, spiders, or avatars) to search the Site, other than the search functionality offered through the Site or other generally available web browsers; (l) link directly to any image hosted on the Site in a manner that would cause the image on the Site to be hosted on another web site; (m) link to the Site in such a manner that the Site or any portion thereof is “framed” on another web site; (n) attempt to reverse-engineer or decrypt any software on the Site; (o) to attack the Site via a denial-of-service attack or a distributed denial-of-service attack; (p) provide archived or cached data sets of content on the Site to any other entity; or (q) facilitate or encourage the violation of any of the policies set forth in these Terms.

MOBILE SERVICE

If the Site is accessible via a mobile device, FW PAC does not charge a fee for this, but your mobile service carrier fees may still apply. Further, downloading, installing, or using certain portions of the Site may be prohibited or restricted by your mobile service carrier, and not all features may function properly with all carriers, devices, or software. FW PAC recommends you check with your mobile service carrier to find out what restrictions, if any, may be applicable to your mobile service.

TEXT MESSAGE PROGRAMS

By agreeing to participate in the text message service, you authorize FW PAC to deliver advertisements and/or telemarketing messages to any mobile telephone number provided by you to ROA, using an automatic telephone dialing system or an automated system for the selection or dialing of telephone numbers. Consent to participate in the Service is not required as a condition of purchasing any property, goods or services. You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to FW PAC, FW PAC will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from FW PAC. You must provide FW PAC with a valid mobile number. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at forwardwisconsin2026@gmail.com. Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from FW PAC and to FW PAC from you. You will receive messages at various intervals. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

The Site may contain links to other websites. FW PAC does not monitor or check the accuracy of such third-party materials and accordingly, FW PAC has no control over such third-party sites and resources. FW PAC is: (a) not responsible for the availability of such external sites or resources; and (b) does not endorse and is not responsible or liable for any advertising, products, or other materials on or available from such third parties. If you decide to access a third-party link, you do so at your own risk. You should review any terms and conditions and privacy polices prior to navigating to such third-party site from the Site.

CONTRIBUTIONS TO FW PAC

FW PAC does not solicit unsolicited feedback, ideas, documents, suggestions, or other information (“Contributions”) about its services. If you provide a Contribution, FW PAC will be free to use any Contributions provided by you for any purpose, such as improving its services and creating derivative technologies based upon such Contributions. All Contributions are provided voluntarily and free of any third-party rights or encumbrances.

MODIFICATIONS TO SITE

FW PAC reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice. FW PAC will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site.

TERMINATION

FW PAC may terminate or suspend, without notice and in its sole discretion, your access to the Site.

GENERAL

These Terms and the Privacy Policy comprise the entire agreement between you and FW PAC with regard to your use of the Site and supersede all prior or contemporaneous negotiations, discussions, or agreements, whether written or oral, between the parties regarding the subject matter contained herein. All notices, requests, or other communications must be in writing and sent via email or US pre-paid post to the authorized representative of the other party. If any part of these Terms is found to be illegal, unenforceable, or invalid, then that part will be removed, and remaining provisions will continue to be valid and enforceable. No joint venture, partnership, employment, agency, or exclusive relationship will exist between you and FW PAC. Any failure to enforce any provision of these Terms will not constitute a waiver of such rights. All indemnities, licenses, disclaimers, limitations, and restrictions of warranty will survive termination of these Terms, as well as the provisions of this “General” section.
